I am Dr Trevor Fox. I was a partner in a leading Insurance practice before
establishing my own Insurance litigation firm which I later sold to a large insurance firm. I have spent over 30 years in practice,
and the last 25 resolving claims by mediation
I offer, both as a mediator and as an advocate representing parties at mediation
Yes, in response to the current crisis, I have been trained to mediate online. All you need is a phone or laptop. The platform allows me to manage group meetings and individual sessions with complete confidentiality and security; to ‘screenshare’; and to share files and documents.
A day or two before the mediation I will contact you and invite you to an online meeting at which we can ensure that the controls are set up correctly to enable you to hear and see and be heard and seen. If your phone or laptop is controlled by your employer, I may need to liase with your IT department to ensure that you are able to make the necessary connection, but this is a minor inconvenience in return for the huge benefit.
I also recommend to all parties that shortly before the mediation they draft their own realistic version of the settlement. You will find that
a) it focuses the mind on the reality of an achievable deal and
b) importantly, means that if you do settle there is already a working draft document that you can easily adapt, rather than having to draft under pressure at the end of what may be a long and tiring day. You can then share your updated draft through the platform in order to sign off on the day.
I can arrange a venue local to you according to your budget. Typically, mediations are held in easily accessible hotels and conference venues or at one of the parties’ lawyers’ offices.
For the time being I am only mediating online.
A mediation typically lasts for one day. Very complex cases may stretch to two days.
It can often take two to three months from deciding to mediate to actually mediating
but I urge you to shorten this process so that you do not lose momentum.
If the issues have already been set out whether in correspondence or in pleadings
it can be possible to mediate the claim within as little as week or two. However,
a one-month schedule will allow a sensible exchange of information; agreement on a
core bundle; and sufficient preparation for all involved.
Mediations rarely fail completely. Even if a settlement is not achieved on the day, the
door is open to further negotiation. At the very least the issues are narrowed.
